QNX Software Systems Questionable Licenses...

I was reading the license for the Non-Commercial edition of QNX and I found some rather questionable sections:

Part B, Section 9, Subsection C (“Governing Law”) States:

“The parties hereby irrevocably waive: (1) the provisions of the United Nations Convention on Contracts for the International Sale of Goods, and (2) any right to a trial by jury regarding the resolution of any dispute between the parties hereto arising out of or in connection with this Agreement.”

Part C, Section 1, Subsection C (“Momentics IDE”) States:

“The Momentics Non-Commercial Software does not include the Momentics Integrated Development Environment. This technology alone is good reason to obtain a commercial license for the Momentics PE development suite. This plug for the IDE allows the legal staff not to delete this section C1(c) and thereby mess up our section numbering system between licenses”.

This license agreement looks like very Microsoft’ish. Maybe QSSL hired somebody from Microsoft and he/she happened to be assigned the job to do this license agreement :wink:
